MileGuard Terms of Service

These Terms of Service ("Terms") govern your use of the MileGuard mobile application ("App") operated by Wudget ("we," "our," or "us"). By using MileGuard, you agree to these Terms.

1. Description of Service

MileGuard is a mileage tracking tool for vehicle leases. It helps you monitor odometer readings, project mileage at lease end, estimate potential overage fees, and track vehicle maintenance. The App is available as a free version with optional premium subscription features.

2. Account Registration

You must create an account to use MileGuard. You may sign in using email, Google, or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Subscriptions and Payments

MileGuard Premium is available through auto-renewing subscriptions (monthly or yearly). Subscriptions are processed by Apple through the App Store. By subscribing, you agree to Apple's terms for in-app purchases, including their auto-renewal and cancellation policies.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.

4. Smartcar Integration

If you connect your vehicle through Smartcar, you authorize MileGuard to access your odometer reading, VIN, and vehicle information through the Smartcar API. You can revoke this access at any time through the App's Settings. Your use of Smartcar is also subject to Smartcar's terms of service.

5. Accuracy Disclaimer

MileGuard provides mileage projections, pace estimates, overage cost calculations, and benchmark comparisons for informational purposes only. These calculations are based on the data you provide and your historical driving patterns.

We do not guarantee the accuracy of any projection, estimate, or recommendation. Actual mileage, overage fees, and lease terms are determined by your lease agreement and your vehicle's odometer. Always refer to your lease contract for definitive terms.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with the App's operation or other users' access
  • Misrepresent your identity or provide false information
  • Use automated systems to access the App in a manner that exceeds reasonable use

7. Intellectual Property

MileGuard, its design, features, and content are owned by Wudget and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Data and Privacy

Your use of MileGuard is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • MileGuard is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • We are not responsible for any financial decisions or outcomes based on the App's projections, estimates, or recommendations.
  • Our total liability for any claim arising from the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App's Settings.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of material changes by updating the "Last Updated" date.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
